collaborative negotiations

In collaborative negotiations, the parties each rely on a collaborative lawyer. The parties conduct negotations with and in presence of these collaborative lawyers to reach an amicable agreement. 

 

Ath the start of the negotiations, a so-called collaborative protocol is signed. This agreement contains the 'rules' that the lawyers and parties must adhere to. Financial agreements are included therein and the nature of the dispute is described. 

 

The collaborative negotiations are conducted on a voluntary basis and are strictly confidential. To safeguard this confidential nature, the collaborative lawyers will have to withdraw from the dispute between the two parties if agreement is reached. 

In that case, the parties can still submit their dispute to court. 

If an agreement is reached, it can be submitted to the court for approval.
